OVERVIEW
In the interest of protecting the assets of the Credit Union and maximizing dividends to members, the Board of Directors adopts the following policy.
This policy outlines the various actions, up to and including expulsion from membership, which Access Credit Union may take in response to behavior that is illegal, threatening, abusive, or otherwise disruptive to credit union operations and/or any activity that causes a financial loss, is associated with fraud, and/or increased reputational or regulatory compliance risk to the Credit Union. Any suspension or limitation of service is subject to the discretion of appropriate management personnel.
This policy is not enacted to restrict the rights of membership, but rather to address certain unacceptable conduct and protect the Access Credit Union's members, employees, and property.
All members are entitled to maintain a single share (defined as the par value share or membership share) in the Credit Union and are eligible to attend, participate and vote at the annual and special meetings of the members and maintain a share account. No other access to products, services, or facilities is a right of membership. All such access may be reduced or limited at the discretion of the Credit Union.
A. MEMBER IN GOOD STANDING
A member in good standing is a member who:
- Maintains at least their minimum share, as defined within the Credit Union’s bylaws;
- Has not had any account with the Credit Union closed due to abuse or negligent behavior;
- Has not caused a financial loss to the Credit Union;
- Has not engaged in violent, belligerent, disruptive, or abusive activities such as:
- Violence, intimidation, threats, harassment, or physical or verbal abuse of duly elected or appointed officials or employees of the Credit Union, members, or agents of the Credit Union. This includes actions while on Credit Union premises and through use of telephone, mail, email or other electronic method;
- Causes or threatens damage to Credit Union property;
- Unauthorized use or access of Credit Union property;
- Knowingly disseminating incorrect, misleading, confidential, or proprietary information regarding the Credit Union;
- Any actions that may cause material risk or financial harm to the Credit Union.
B. MEMBERS NOT IN GOOD STANDING
A member found not to be in good standing (see Section A) is subject to several actions, including possible expulsion. The Credit Union reserves the right to immediately limit such a member's access to products, services, or facilities. Additionally, the Credit Union may revisit and revise the status of members not in good standing. For instance, a member who has caused a financial loss to the Credit Union but demonstrates an intent to repay the loss, as determined by Credit Union management, and follows through with an acceptable repayment plan may not face expulsion but could have their services limited.
C. LIMITING SERVICES
The Credit Union may restrict services for any member who is not in good standing. For violent, belligerent, disruptive, or abusive behavior, the Credit Union will limit services when there is a logical relationship between the behavior and the services being suspended. For example:
- If a member verbally or physically abuses a Credit Union employee or another member, the Credit Union may deny the member access to its premises and/or restrict services to minimize personal contact.
The determination of whether violent, belligerent, disruptive, or abusive behavior has occurred will be at the sole discretion of Credit Union management. The Credit Union will notify the member of any restricted accounts or services.
D. EXPULSION
Any member not in good standing may be expelled by the Credit Union. Expulsion may be temporary or permanent.
- Members expelled for causing a financial loss to the Credit Union may seek reinstatement by repaying the amount owed and reapplying for membership.
E. MEMBERS LIABILITY
Expelled members remain liable to the Credit Union for any outstanding debts or obligations.
F. EXPULSION PROCEDURE
If a member fails to meet the criteria for good standing, the Credit Union CEO, COO, or a VP may expel the member following these steps:
- Immediate Safeguards: The Credit Union will take any necessary actions to protect its personnel and property.
- Application of Shares: Member shares may be applied to cover any financial losses.
- Notification Letter: The member will receive a written notice of expulsion, detailing the reasons for the action and providing instructions for appealing to the board of directors.
- The board of directors will review the appeal at its next scheduled meeting and notify the member of its final decision.
- Remaining Shares: Any remaining shares, after applying them to amounts due, will be returned to the member along with the expulsion notice.
G. NOTICE TO MEMBERS
At least 30 days before the effective date of this policy, the Credit Union will provide notice to all members by posting the policy on its website.
- New members will be provided written notice of this policy prior to or upon applying for membership through the Credit Union's website.
